### UK Health Regulator Calls for Urgent New Laws to Govern AI in NHS
The UK’s primary health regulator, the Medicines and Healthcare products Regulatory Agency (MHRA), is advocating for the urgent introduction of new legislation to govern the use of Artificial Intelligence (AI) within the National Health Service (NHS). MHRA Chief Lawrence Tallon underscored that AI technology is poised for routine integration across the NHS, necessitating a robust legal framework to ensure its safe and effective deployment.
Tallon’s call highlights a critical foresight: while AI promises revolutionary advancements in diagnostics, personalised treatment plans, and operational efficiency within the NHS, its unique characteristics present novel regulatory challenges. Unlike static medical devices, AI systems can evolve, learn from data, and adapt, raising complex questions about accountability, data privacy, algorithmic bias, and continuous oversight.
“Our current regulatory landscape, primarily designed for static medical devices and pharmaceuticals, is not adequately equipped to manage the dynamic nature and inherent complexities of AI,” Tallon is understood to have stated. He stressed the imperative for proactive legislative action rather than reactive measures, to protect patient safety, maintain public trust, and foster responsible innovation.
The proposed legislative framework would likely encompass areas such as stringent validation protocols for AI algorithms, mechanisms for continuous post-market surveillance, clear lines of accountability for AI developers and deployers, and robust ethical guidelines to prevent discrimination and ensure fairness. The aim is not to stifle innovation, but to create an environment where AI’s transformative potential can be realised safely and ethically for the benefit of all NHS patients.
