## Government Issues Landmark Guidance: Biological Sex Mandated for Single-Sex Public Facilities
**LONDON –** The UK government has issued new guidance confirming that public toilets and changing rooms in single-sex facilities must be used according to biological sex. Published on Thursday, the guidance aims to provide unambiguous clarity for service providers following a landmark Supreme Court ruling last year.
The directive stipulates that access to facilities designated for either men or women should adhere strictly to the sex recorded at birth. This applies to a wide array of public and private spaces, including communal changing rooms, public toilets, and facilities within schools, hospitals, and leisure centres.
The move provides a definitive legal framework for public bodies, businesses, and service providers, building upon the Supreme Court’s decision which affirmed that the provision of single-sex spaces, particularly for women, is permissible under the Equality Act 2010. That ruling underscored the importance of such spaces for privacy, dignity, and safety.
A government spokesperson stated that the guidance is intended to resolve previous ambiguities surrounding the interpretation of legal obligations concerning gender identity and sex-segregated facilities. “The intention is to ensure the safety, privacy, and dignity of all individuals, particularly women and girls, by reinforcing the principle of single-sex spaces where appropriate,” the spokesperson added.
While welcomed by groups advocating for women’s single-sex spaces, who have long called for clearer definitions, the guidance is anticipated to draw scrutiny from some LGBTQ+ advocacy organizations who may argue it could negatively impact transgender and non-binary individuals.
This directive marks a significant clarification in the ongoing national conversation about gender identity, sex-segregated spaces, and the application of the Equality Act. Service providers are now expected to review and, if necessary, update their policies and signage to align with the new government mandate, ensuring adherence to the biological sex basis for single-sex facilities across the country.
